1. Role of SG Wholesale Direct Newcastle Pty Ltd
SG Wholesale Direct Newcastle Pty Ltd (“SGWD”, “we”, “us”, “our”) acts solely as an agent for third-party online auction platforms and/or consignors.
SGWD does not act as principal, owner, carrier, or insurer of any goods unless expressly agreed in writing.
2. Custody, Risk & Insurance
2.1 All goods delivered to or held at premises controlled or accessed by SGWD are stored entirely at the owner’s or purchaser’s risk.
2.2 SGWD accepts no responsibility or liability for loss, theft, damage, deterioration, fire, flood, weather exposure, vandalism, mechanical failure, or any consequential loss whatsoever while goods are in our custody or control, whether before or after auction.
2.3 Insurance is the sole responsibility of the client, consignor, or purchaser.
SGWD does not provide insurance coverage for any goods under any circumstances.
2.4 To the maximum extent permitted by law, SGWD excludes all warranties, conditions, and representations relating to the condition, security, or safekeeping of goods.
3. Transport, Collection & Removal
3.1 All transport, loading, removal, and collection of goods is the responsibility of the client, consignor, or purchaser.
3.2 SGWD does not arrange freight unless expressly agreed in writing and does not accept liability for third-party carriers.
3.3 Goods must be collected within 7 days of the auction ending, regardless of whether:
the goods are sold,
the purchaser fails to collect,
the item is unsold and not relisted.
4. Storage Fees
4.1 Goods not collected within 7 days of auction close will incur storage fees automatically and without further notice.
4.2 Storage fees are charged as follows (GST exclusive):
Cars: $250 per week
Trucks / Heavy Vehicles: $400 per week
Palletised goods: $60 per pallet per week
Individual items occupying less than one pallet: $30 per week per item
Items larger than one pallet footprint: $250 per week per item
4.3 All storage charges are rounded up to the next full week.
GST applies to all storage fees.
4.4 Storage fees continue to accrue until goods are collected in full.
5. Payment of Storage Fees
5.1 All outstanding storage fees must be paid in full prior to release or collection of goods.
5.2 SGWD reserves the right to withhold release of goods until all fees, charges, and expenses are paid in cleared funds.
6. Abandoned or Unclaimed Goods
6.1 Goods remaining uncollected for an extended period may be deemed abandoned, without prejudice to SGWD’s right to recover accrued fees.
6.2 SGWD reserves the right, at its discretion, to:
resell the goods,
dispose of the goods,
scrap or destroy the goods,
without further notice, and without liability to the owner or purchaser.
6.3 Proceeds of any resale may be applied first to outstanding storage, handling, and administrative costs.
7. Limitation of Liability
7.1 To the maximum extent permitted by law, SGWD’s total liability (if any) is limited to the value of fees paid to SGWD in relation to the relevant goods.
7.2 SGWD is not liable for:
indirect or consequential losses,
loss of profit,
business interruption,
depreciation,
loss arising from auction outcomes or buyer default.
8. Indemnity
The client, consignor, or purchaser indemnifies SGWD against all claims, losses, damages, costs, and expenses arising from:
ownership of the goods,
failure to insure,
failure to collect goods on time,
third-party claims relating to the goods.
9. GST
Unless stated otherwise, all fees and charges are exclusive of GST and GST will be added where applicable.
10. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of NSW courts.
